This Privacy Policy describes how Trending Family Inc. (DBA Creator Wizard) ("Company," "we," "us," or "our") collects, uses, and protects your personal information when you visit or use any of our websites, including creatorwizard.com, branddealwizard.com, sponsormagnet.com, sponsorgames.com, wizardsguild.com, and mole.creatorwizard.com (collectively, the "Sites"), or purchase any of our products or services.

By using our Sites, you agree to the terms of this Privacy Policy. If you do not agree, please do not use our Sites.

ATTENTION: Important Information About Dispute Resolution and Binding Arbitration

For avoidance of doubt, you acknowledge that the transmission of certain technical information (such as IP address, browser type, and routing data) is a necessary and lawful part of Internet communication in order to provide you with the information and services of this website and that you have given your consent for us to collect this information to operate our website.

By accessing or using our Sites, you agree that any dispute, claim, or controversy arising out of or relating to the Company's collection, use, disclosure, or retention of your personal information, including but not limited to any claim under the California Invasion of Privacy Act ("CIPA"), the California Consumer Privacy Act ("CCPA"), or similar state privacy or wiretap laws, shall be resolved exclusively through binding arbitration, rather than in court. You waive any right to a jury trial.

All disputes must be brought in your individual capacity and not as a plaintiff or class, collective, consolidated, or representative participant. The arbitrator shall not consolidate or join the claims of other users. If a court determines that this waiver of class or representative actions is unenforceable with respect to a particular claim, that claim must be severed and proceed in court while the remaining claims continue in arbitration.

Arbitration shall take place in Hennepin County, Minnesota before the American Arbitration Association under its Consumer Arbitration Rules. Arbitration fees and costs shall be allocated in accordance with the applicable AAA rules. Judgment on the award may be entered in any court of competent jurisdiction. This Privacy Policy and any dispute arising hereunder shall be governed solely by the laws of the State of Minnesota, without regard to its conflict-of-laws principles.

Notwithstanding the foregoing, the Company retains the right, at its sole election, to bring any of the following claims in state or federal court of competent jurisdiction rather than in arbitration: (a) claims to enforce, protect, or defend the Company's intellectual property rights, including copyrights, trademarks, trade secrets, and patents; (b) claims seeking temporary, preliminary, or permanent injunctive or other equitable relief, including to prevent unauthorized access to, scraping of, or misuse of data or content from the Company's Sites or products; (c) claims for the collection of unpaid fees or amounts owed to the Company; and (d) claims that fall within the jurisdictional limits of a small claims court. The Company's election to pursue any such claim in court does not waive its right to compel arbitration of any other dispute.

Before initiating arbitration, you must send a written notice of dispute to support@creatorwizard.com identifying your name, contact information, and the specific nature of the claim. Both parties will make a good-faith effort to resolve the dispute informally. If the dispute is not resolved within sixty (60) days, either party may commence arbitration.

You may opt out of this arbitration agreement by providing written notice to support@creatorwizard.com within thirty (30) days after first accepting this Privacy Policy or otherwise providing personal information through our Sites. If you opt out, you retain your right to bring individual claims in court, but waive participation in any class or representative action.

Nothing in this clause waives any statutory or common-law defenses, including the defense that the Company's use of cookies, pixels, or analytics technologies is permitted under applicable law.

This arbitration provision survives termination of your relationship with the Company. If any portion of this provision is found unenforceable, that portion shall be severed and the remainder enforced to the maximum extent permitted by law, except that if the class/representative-action waiver is found unenforceable, the entire arbitration provision shall be void as to that claim.

1. Information we collect

Information you provide directly: We collect information you provide when you sign up for our email list, purchase a product or service, fill out a contact form, apply for coaching, or otherwise communicate with us. This may include your name, email address, phone number, mailing address, and payment information.

Information collected automatically: When you visit our Sites, we automatically collect certain technical information including your IP address, browser type, operating system, referring URLs, and pages visited. This is collected through the tools described in Section 4 below, and only after you provide consent via our cookie banner (where required).

Purchase information: When you purchase a product or service through our Sites, payment processing is handled by our third-party processors. Spiffy processes purchases of Courses, coaching, events, and Sponsor Mole subscriptions; Stripe processes one-time Sponsor Mole search-credit purchases. Card payments are entered on the processor's hosted pages, and we do not store your credit card information on our servers. Our payment processors collect and process payment data in accordance with their own privacy policies.

2. Sponsor Mole — Sponsorship Contact Data and AI

Sponsor Mole (mole.creatorwizard.com) is a Creator Wizard product that helps creators identify the right sponsorship contact at a brand and draft outreach to them. This section describes categories of data processing that are different from the rest of our Sites, so we're calling them out separately.

Data about our subscribers. If you are a Sponsor Mole subscriber, we collect the same categories of information described in Section 1 (name, email, and payment information via Spiffy for subscriptions or Stripe for one-time search-credit purchases), plus your usage of the product (searches run, brands researched, contacts saved, pitches generated, and your selected content niches).

Data about third parties found through Sponsor Mole. In providing this service, we source professional contact information (name, job title, business email, LinkedIn profile) about individuals who work at companies our creator-subscribers are researching from Apollo.io, a third-party professional data provider. Apollo aggregates this information from multiple sources, including publicly available professional profiles, company websites, and business directories, as well as licensed third-party datasets and a contributory network of businesses that share professional contact information. Work email addresses in particular are sourced predominantly through this contributory business network rather than from publicly available sources. Because these sources frequently overlap for any given individual, a precise breakdown between public and non-public sources is not available for all fields. These individuals have not signed up for or interacted with Creator Wizard directly, have not agreed to this Privacy Policy, and are a materially different category of data subject than our own customers. We process their professional contact information under applicable law as described in this section, and they may exercise the rights described below regardless of whether they have visited our Sites.

What we do with this data: We display it to the Sponsor Mole subscriber who searched for it, and  if that subscriber chooses it may be saved to their account for later reference. Cached and saved contact data is stored on a strict per-subscriber basis, accessible only to the individual subscriber it pertains to, and is never placed in a shared or global directory.

AI processing (pitch and research generation). Sponsor Mole uses Anthropic's Claude API to generate personalized outreach drafts and brand research for subscribers. To do this, at the time content is generated we send limited inputs (such as a business contact's name and job title and the brand being researched) to Anthropic for processing ("inference"). This data is not used to train or fine-tune any AI model: Anthropic does not train on data submitted through its API, and the terms of our contact-data provider prohibit the use of its data as AI training data. AI-generated output is provided to the subscriber as a draft template for the subscriber's own review, editing, and use. Creator Wizard does not send outreach communications to third-party contacts on behalf of subscribers. Subscribers are solely responsible for their own outreach activities and for compliance with applicable marketing laws, including CAN-SPAM and TCPA. AI-generated output can contain errors and should be reviewed before use.

Retention: We retain a temporary cache of previously-found contacts (typically 30 days) to avoid re-querying our data providers for repeat searches. A subscriber's own saved-contact list persists until they delete it or we honor an opt-out request (below).

Your rights if we have your professional contact information: If you are one of these individuals and would like us to stop displaying your information and remove it from our systems, visit mole.creatorwizard.com/opt-out or email support@creatorwizard.com. To help us locate and remove your information, please provide your work email address; you may also provide your name and the brand or company you are associated with. Upon receipt of a valid request, we will suppress your information from new search results within five (5) business days and complete full removal from our active systems within 30 days. We will add you to a suppression list so your information is not reintroduced by future searches. We cannot retrieve or delete copies of your information that a subscriber has already exported outside our platform, but no new access to your information will occur through our service after suppression. This does not affect the records of our third-party data providers; you may separately need to opt out directly with Apollo at apollo.io/company/privacy-center.

3. Cookie consent

We use a cookie consent banner on our Sites that require tracking scripts. Non-essential scripts, including analytics and ad attribution tools, are only loaded after you click "Accept" on our cookie banner. If you click "Decline," no non-essential tracking scripts will run during your visit. Your choice is stored in your browser's local storage so the banner does not reappear on future visits.

You can reset your consent preference at any time by clearing your browser's local storage for our domain.

4. Third-party tools and tracking

We use the following third-party tools and service providers in operating our Sites and products. Tracking and analytics tools are only loaded after you provide consent via our cookie banner:

Google Analytics (GA4) — We use Google Analytics to understand how visitors interact with our Sites. Google Analytics collects information such as pages visited, time spent on site, and general geographic location. It does not collect your name or email address through this tool. You can opt out of Google Analytics at tools.google.com/dlpage/gaoptout.

Google Tag Manager — We use Google Tag Manager to manage the deployment of scripts on our Sites. It acts as a container for the tools listed here and only fires after consent is given.

Hyros — We use Hyros, an ad attribution tool, to understand which marketing channels lead visitors to our Sites. Hyros may collect your IP address, page URL, referring URL, and click behavior. This data is used solely for internal marketing attribution. You can learn more at hyros.com. Hyros is only loaded after you provide consent via our cookie banner.

Framer — Our marketing Sites are built on Framer, which may collect basic analytics data as part of its platform. This is independent of our consent banner. For more information, see Framer's privacy policy at framer.com/legal/privacy.

Kit (formerly ConvertKit) — We use Kit to manage our email list and send newsletters. When you subscribe to our email list, your name and email address are stored in Kit. Kit's privacy policy is available at kit.com/privacy.

Spiffy — We use Spiffy to process purchases of Courses, coaching, events, and Sponsor Mole subscriptions, and to let Sponsor Mole subscribers view, manage, or cancel their subscription. Spiffy collects and processes billing and order information. Spiffy's privacy policy is available at spiffy.co/privacy.

Stripe — We use Stripe to process one-time Sponsor Mole search-credit purchases. Stripe collects and processes billing and payment information in accordance with its own privacy policy at stripe.com/privacy.

Apollo.io — We use Apollo, a third-party contact-data provider, to source the professional contact information described in Section 2. Apollo's own privacy practices are described at apollo.io/privacy-policy.

Anthropic (Claude) — We use Anthropic's Claude API to generate the outreach drafts and brand research described in Section 2. Limited inputs (such as a contact's name and title and the brand being researched) are sent to Anthropic at the time content is generated; this data is used for inference only and is not used to train AI models. Anthropic's privacy policy is available at anthropic.com/legal/privacy.

Google Programmable Search and YouTube Data API — We use Google's Programmable Search and the YouTube Data API to perform brand research and to read publicly available channel information for Sponsor Mole. Search queries and channel handles are sent to Google to return results. Google's privacy policy is available at policies.google.com/privacy.

5. How we use your information

We use the information we collect to:

Deliver products, services, and content you have purchased or requested, including surfacing sponsorship contact data and generating outreach drafts and brand research through Sponsor Mole

Send you our email newsletter and promotional communications (with your consent)

Respond to your inquiries and provide customer support

Improve our Sites and understand how they are used

Comply with legal obligations

Protect against fraud and unauthorized activity, including automated or bulk misuse of Sponsor Mole

We do not share your personal information with third parties for their own marketing purposes.

If Trending Family Inc. or substantially all of its assets are acquired, merged, reorganized, or enter bankruptcy, your personal information may be transferred to a successor entity as part of that transaction. In such event, we will make reasonable efforts to notify you before your personal information becomes subject to a different privacy policy.

6. Email marketing

When you subscribe to our email list, you consent to receive our newsletter, promotional emails, and updates. Each email we send includes an unsubscribe link. You can also unsubscribe at any time by emailing support@creatorwizard.com.

We use Kit to manage our email list. Your email address and name are stored in Kit's systems. We do not share your email address with any other third party for marketing purposes.

7. SMS and phone communications

If you provide your mobile phone number and opt in to SMS and phone communications, you consent to receive text messages and phone calls from Creator Wizard. These may include updates, promotional offers, and information related to our products and services. Message frequency will vary. Standard message and data rates may apply. Reply STOP to opt out at any time, or HELP for assistance. You can also contact us at support@creatorwizard.com.

8. Data retention

We retain your personal information for as long as necessary to provide you with our products and services, comply with legal obligations, and resolve disputes. If you would like your information deleted, please contact us at support@creatorwizard.com.

For Sponsor Mole specifically: cached search results (contact information about third parties, see Section 2) expire automatically after approximately 30 days. A Sponsor Mole subscriber's own saved-contact list persists until they delete it, their subscription is cancelled and the account is later purged, or we honor a third-party opt-out request.

9. Your rights under CCPA (California residents)

If you are a California resident and the California Consumer Privacy Act applies to our processing of your personal information, you may have the following rights:

The right to request deletion of your personal information

The right to opt out of the sale or sharing of your personal information

The right to non-discrimination for exercising your privacy rights

The right to data portability

The right to request correction of inaccurate personal information

Depending on your state of residence, you may have additional rights, including the right to opt out of targeted advertising or profiling, and the right to limit the use of sensitive personal information. We will not discriminate against you for exercising any of your privacy rights.

To protect your personal information, we may take reasonable steps to verify your identity before responding to a privacy request. Verification methods may vary depending on the nature of the request and the sensitivity of the information involved. You may also authorize an agent to submit a request on your behalf by providing written authorization or a valid power of attorney.

If we decline to act on a request, you may appeal by emailing support@creatorwizard.com with the subject line "Privacy Appeal." We will respond to your appeal in accordance with applicable law.

To exercise any of these rights, please submit a request to support@creatorwizard.com. We will respond within 30 days.

10. Your rights under GDPR (European Union and United Kingdom residents)

If you are located in the European Union or the United Kingdom, you have the following rights under the General Data Protection Regulation (and, for UK residents, the UK GDPR):

The right to erasure ("right to be forgotten")

The right to restrict processing

The right to data portability

The right to object to processing

The right to withdraw consent at any time

If you are one of the third-party individuals whose professional contact information Sponsor Mole has surfaced (rather than a Creator Wizard customer), the following additional information applies to you. We process your professional contact information (name, job title, business email, LinkedIn profile) on the basis of our legitimate interest in facilitating business-to-business sponsorship relationships (Article 6(1)(f) GDPR). We obtain this data from Apollo.io, a third-party business data provider that aggregates professional contact information from public and proprietary sources. We share your data with the individual Sponsor Mole subscriber who searched for it, and limited inputs (your name, title, and the brand you work for) may be sent to Anthropic for AI-assisted pitch generation as described in Section 2. We retain cached contact data for approximately 30 days; a subscriber's saved copy persists until deleted or until we honor an opt-out request. You have the right to object to this processing at any time by visiting mole.creatorwizard.com/opt-out or emailing support@creatorwizard.com, and we will process your request within 30 days.

To exercise any of these rights, please contact us at support@creatorwizard.com. You also have the right to lodge a complaint with your local supervisory authority.

11. Children's privacy

Our Sites are intended for individuals 18 years of age and older. We do not knowingly collect personal information from individuals under 18. If you believe we have inadvertently collected information from an individual under 18, please contact us at support@creatorwizard.com and we will delete it promptly.

12. Third-party links

Our Sites may contain links to third-party websites. We are not responsible for the privacy practices of those sites. We encourage you to review the privacy policies of any third-party sites you visit.

13. Security

We take reasonable technical and organizational measures to protect your personal information. However, no transmission over the internet is 100% secure. Payment processing is handled entirely by our third-party processors (Spiffy or Stripe) — we do not store credit card information on our servers.

14. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of our Sites after any update constitutes your acceptance of the revised policy. We encourage you to review this page periodically.

15. Do Not Track

We do not currently respond to "Do Not Track" browser signals or similar mechanisms. If a uniform standard for responding to such signals is adopted, we will update this policy accordingly.

16. Severability

If any provision of this Privacy Policy is found by a court or other authority of competent jurisdiction to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
